Terms built for practical use.
These terms govern the OpsForge website, purchases, and use of OpsForge digital products. By placing an order or using a product, you agree to them.
Eligibility and authority
You must be legally able to enter a contract and, when purchasing for a company, authorized to bind that company. OpsForge may decline or cancel an order involving suspected fraud, misuse, pricing error, or unlawful activity.
Products and orders
OpsForge products are downloadable spreadsheet systems supplied in Excel, Google Sheets-ready, and Apple Numbers-ready editions, accompanied by PDF guidance. Bundles contain all three editions for each included system. Product pages describe the intended workflow, compatibility, contents, sample data, and limitations. Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes may be added at checkout.
An order is complete only after payment is confirmed. Keep the receipt and a secure backup of downloaded files. OpsForge may improve a product over time but does not promise future features, updates, or ongoing hosting of a particular version.
Custom projects
The Custom Product Builder provides a non-binding planning estimate only. A custom project begins only after OpsForge and the client approve a written Custom Project Agreement and Statement of Work describing the requirements, deliverables, exclusions, fixed price, payment schedule, revision allowance, acceptance criteria, data handling, and delivery target.
Unless the signed agreement says otherwise, projects below $500 are paid in full before work starts; projects of $500 or more use a 50% commencement payment and a 50% balance due after acceptance and before final editable delivery. Applicable taxes are additional. The selected revision rounds consist of consolidated written feedback, and requirements added after approval require a written change order.
The signed custom-project agreement controls if it conflicts with these general website terms. Review the Custom Project Standard and terms before requesting a project.
Business-use license
After a valid purchase, OpsForge grants the purchasing business a limited, non-exclusive, non-transferable license to customize and use that product internally for its own estimates, proposals, accounting preparation, workflow control, pricing reviews, and operating decisions. Employees and contractors working for that business may use the file for those internal purposes.
You may not resell, publish, distribute, sublicense, share with an unrelated business, offer as a template or service, remove ownership notices, reverse engineer protected logic for redistribution, or repackage any workbook, guide, image, copy, or derivative as a competing product. Client-facing proposals generated from the workbook may be shared with the intended client.
OpsForge retains all ownership and intellectual-property rights not expressly granted. EstimatePro and the OpsForge brand are proprietary to OpsForge LLC.
Your responsibility for estimates
OpsForge products are business aids. You are responsible for replacing demonstration data and validating every quantity, rate, source record, burden, supplier quote, field condition, production assumption, tax treatment, scope, approval, contract term, permit, code requirement, and safety obligation before commercial use.
The products do not provide legal, tax, accounting, engineering, architectural, medical, safety, or other licensed professional advice. They do not replace applicable trade expertise, site investigation, manufacturer instructions, contracts, or professional judgment.
Refunds and access
Digital-product refunds and file-access issues are handled under the Refund Policy. If a refund is issued, the associated license ends and all copies must be deleted. Download access may be limited, expire, or be revoked following a refund, chargeback, dispute, fraud finding, or license violation.
Acceptable website use
You may not interfere with website security, probe protected systems, automate abusive requests, attempt unauthorized downloads, submit malicious content, misuse the support assistant, impersonate another person, or use the site in violation of law or another party's rights.
Disclaimers
To the maximum extent permitted by law, the website and digital products are provided “as is” and “as available.” OpsForge disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that a workbook will produce a particular price, margin, contract award, profit, or business result.
Limitation of liability
To the maximum extent permitted by law, OpsForge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost revenue, lost data, business interruption, underpricing, overpricing, project loss, or claims arising from your estimate or work. OpsForge's aggregate liability relating to a product will not exceed the amount you paid for that product during the twelve months before the claim.
Some jurisdictions do not allow particular exclusions or limits, so portions of this section may not apply to you. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.
Governing rules and disputes
These terms are governed by the laws of the State of Minnesota and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to contact OpsForge and allow 30 days for a good-faith attempt to resolve the issue. Claims must be brought individually and not on a class or representative basis where that waiver is permitted by law.
Changes and contact
We may update these terms prospectively. The version in effect when you place an order governs that purchase unless a change is required by law. Questions may be sent to terms@opsforge.llc.
Our handling of personal information is described in the Privacy Policy.
